A Chapter 13 Bankruptcy can help with a 1st or 2nd mortgage that is in arrears. A Chapter 13 is a payment plan that distributes the arrearages over a 3 or 5 year period. This makes the repayment of arrearages much easier. Once it is determined that the client would be able to make all the necessary payments (the 1st and 2nd mortgage as well as the arrearages monthly payment) then a Chapter 13 would be a good solution. In this case, a Chapter 13 would allow the client to keep the house and not go into foreclosure.
